Transgender Community Protests Against Controversial Bill in Delhi

In a significant demonstration at Jantar Mantar, the transgender community in Delhi protested against the newly proposed Transgender Persons (Protection of Rights) Amendment Bill. They argue that the Bill undermines their rights and dignity, contradicting previous legal frameworks that recognized their identity. Protesters expressed concerns that the legislation criminalizes their existence and restricts self-identification. With the Bill already passed by both houses of Parliament, the community is demanding its withdrawal and the implementation of the landmark NALSA judgment that affirmed their fundamental rights. This protest highlights ongoing struggles for equality and recognition within the transgender community.

Protest at Jantar Mantar

New Delhi, March 26: Members of the transgender community gathered at Jantar Mantar in Delhi on Thursday to voice their opposition to the recently proposed Transgender Persons (Protection of Rights) Amendment Bill. They argue that the legislation infringes upon their rights and dignity.

The demonstrators, a significant number from the community, expressed their discontent with the government, asserting that the Bill contradicts the ideals of equality and self-identification.

According to the protesters, the Bill has already received approval from both the Rajya Sabha and Lok Sabha and is now pending the President's approval. They believe it threatens the rights previously guaranteed to transgender individuals under existing laws.

One protester remarked, “The Parliament passed this Bill yesterday. The Supreme Court's landmark ruling in the National Legal Services Authority vs. Union of India recognized transgender individuals as the ‘third gender’ and upheld their fundamental rights. A law enacted in 2019 allowed individuals to identify their gender freely. However, this new Bill strips away that right to self-expression.”

Another protester added, “This Bill criminalizes our identity and fosters distrust, viewing our existence through a medical lens.”

Expressing further dismay, a protester stated, “Transgender individuals were previously able to express their identities freely, but this Bill has revoked those rights. We are here to demand the implementation of the NALSA judgment. This law is oppressive and undermines our rights.”

Another voice from the crowd said, “This Bill diminishes the dignity of transgender individuals, indicating a lack of regard for our existence. It implies that the government will determine our legitimacy.”

Another protester insisted, “We call for the withdrawal of this Bill, which has been introduced without proper consultation with our community. While it claims to protect us, it restricts the definition of transgender identity and denies individuals the right to self-identify.”

Notably, the Bill excludes individuals with "self-perceived gender identities" from its definition of a "transgender person."

The Rajya Sabha approved the Bill on Wednesday, following its clearance by the Lok Sabha. Opposition members had urged that the Bill be reviewed by a select committee, raising concerns that certain provisions could negatively affect the dignity and rights of transgender individuals.
