Supreme Court to Hear Controversial Voter List Revision Case Involving Opposition Leaders
Key Hearing Scheduled in Supreme Court
New Delhi: A significant hearing regarding the Special Intensive Revision (SIR) of the voter list is set for Thursday, October 15, 2026, in the Supreme Court. The petitions filed by Rahul Gandhi, the Leader of the Opposition in the Lok Sabha, along with other leaders from the opposition INDIA alliance, will be reviewed. Additionally, a petition from AIMIM chief Asaduddin Owaisi is also on the agenda. These petitions raise concerns about the Election Commission's SIR process, alleged irregularities in the voter list, and issues related to the removal of names.
Opposition Raises Concerns Over SIR Process
The SIR, or Special Intensive Revision, is designed to verify and amend names on the voter list to enhance its accuracy. However, political disputes have emerged regarding the removal of names, document verification, and the rights of eligible voters during this process.
Opposition leaders have alleged potential irregularities in the name removal and amendment process, asserting that transparency must be ensured and that no eligible voter's name should be removed without due process. These concerns have prompted the opposition to approach the Supreme Court.
Joint Petition Filed by Opposition Leaders
A joint petition filed by Rahul Gandhi and other leaders from the INDIA alliance seeks a judicial review of the Election Commission's decisions and the SIR process. The petition includes prominent figures such as Congress President Mallikarjun Kharge, Trinamool Congress MP Sougata Roy, Samajwadi Party leader Akhilesh Yadav, RJD leader Tejashwi Yadav, Shiv Sena (Uddhav Balasaheb Thackeray) MP Sanjay Raut, CPI(M) General Secretary MA Baby, CPI General Secretary D. Raja, Jharkhand Mukti Morcha MP Mahua Maji, NCP MP Supriya Sule, and Indian Union Muslim League leader E.T. Mohammed Basheer.
The petition calls for an independent audit of the names removed and amended from the voter list, requesting the formation of a committee led by a retired Supreme Court judge, comprising technical experts and respected citizens. The petitioners have also demanded that the Election Commission provide records related to the SIR, details of meetings, decision-making processes, and logs of the digital system to investigate the disputed decisions.
Asaduddin Owaisi's Petition Also Listed for Hearing
AIMIM leader Asaduddin Owaisi has filed a separate petition challenging the SIR process in the Supreme Court. On October 14, his lawyer mentioned the case before Chief Justice Suryakant and Justice Joymalya Bagchi, leading to the agreement to list it for hearing alongside other related petitions on October 15.
Owaisi's petition also pertains to the voter list revision process, with opposition parties demanding adherence to established rules during changes to the voter list and ensuring affected voters have ample opportunity to voice their concerns.
Concerns Regarding Chief Election Commissioner Gyanesh Kumar
Amid the SIR controversy, petitions related to protests against Chief Election Commissioner Gyanesh Kumar are also scheduled for hearing in the Supreme Court. These cases address issues such as the detention of protesters, alleged police actions, and the closure of certain metro stations in Delhi, which disrupted train services.
The opposition parties are questioning the accountability of the Election Commission regarding the SIR process and have called for action against the Chief Election Commissioner. Conversely, the final legal position regarding the Election Commission's role and the controversies surrounding the voter list revision will only become clear after the court's deliberations and orders.
What Demands Have Been Made in the Supreme Court?
The joint petition from opposition leaders requests an investigation into the decisions related to the SIR, the presentation of relevant records, an independent audit of changes made to the voter list, and directives to safeguard the rights of eligible voters. The petitioners have also sought a temporary halt to the SIR process until a final decision is reached.
The Supreme Court is set to hear these matters before Chief Justice Suryakant and Justice Joymalya Bagchi. The court will consider the issues raised in the petitions, the documents available, and the arguments from the involved parties.
Legal Direction Expected from Upcoming Hearing
All eyes are on the hearing scheduled for October 15, as the court's stance could significantly clarify how complaints related to the SIR process will be investigated and what directives are necessary to ensure transparency in changes to the voter list.
However, the allegations made in the petitions are currently claims from the petitioners and cannot be considered established facts until verified by the court. The direction given by the court during the hearing and the response from the Election Commission will determine the future course of this matter.
