Supreme Court Initiates Contempt Proceedings


In a significant move, the Supreme Court of India has launched suo motu contempt proceedings against Ajay Shukla, a journalist and YouTuber based in Chandigarh. This action follows Shukla's controversial video, which contained what the court deemed 'scandalous' and defamatory remarks about several judges of the apex court.


The bench, led by Chief Justice BR Gavai along with Justices Augustine George Masih and AS Chandurkar, ordered the immediate removal of the video and prohibited the YouTube channel from republishing it or any similar content.


Solicitor General Tushar Mehta characterized Shukla's comments as 'very serious' and expressed appreciation for the court's decision to address the matter proactively.


The Chief Justice emphasized that while the Constitution protects freedom of speech, it is not absolute and must adhere to reasonable limitations. He stated, 'One cannot make allegations that defame a judge and undermine the integrity of the judiciary.'


The court has instructed the registry to formally register the case against Shukla and has made the YouTube channel a party to the proceedings. The Attorney General and Solicitor General have been invited to assist the court in this matter.


As an interim measure, the bench has ordered the YouTube channel to cease publication of the video and to remove it immediately.


Shukla's recent video included remarks targeting retired judge Bela M Trivedi.
