Supreme Court Presents Options to Main Accused in Murder Case

The Supreme Court on Tuesday offered two choices to the primary accused, Sonam Raghuvanshi, who is charged with conspiring to murder her husband, Raja Raghuvanshi. This case is linked to a petition from the Meghalaya government challenging the bail granted to Sonam by a lower court, which was also upheld by the Meghalaya High Court. The bench, comprising Justices M.M. Sundresh and P.B. Varale, informed Sonam's lawyer that the court could either decide on the merits of the Meghalaya government's appeal against her bail after hearing arguments or instruct her to surrender for questioning by witnesses while the bail issue is under consideration.

The court verbally stated that Sonam's lawyer had two options: either the court would issue an order based on merits or request her to surrender, allowing government witnesses to interrogate her. Meanwhile, the court would deliberate on the bail matter. Sonam's lawyer requested time to respond and indicated that they would provide an answer by Thursday. During the hearing, the court also questioned Sonam's behavior following the incident and sought clarification on her previous claims that she was not informed of the grounds for her arrest. Representing the Meghalaya government, Solicitor General Tushar Mehta argued against Sonam's bail, asserting that she voluntarily surrendered to the police and could not later contest her arrest on the grounds of not being informed. He stated that any errors in the arrest memo were merely clerical mistakes and emphasized that if a suspect is caught in the act, there is no need to explain the reason for arrest. He further noted that if an individual surrenders, they cannot claim ignorance of the arrest reasons.

Previously, the family of businessman Raja Raghuvanshi from Indore reiterated their demand for a CBI investigation into the murder. They emphasized the necessity of involving a central agency for a thorough investigation. Raja's elder brother, Vipin Raghuvanshi, raised this demand again after the Supreme Court declined to stay the Meghalaya High Court's order that upheld the bail granted to Sonam, the main accused and Raja's wife. Vipin stated that in cases involving the death of a prominent individual's child, a CBI inquiry is typically ordered immediately. However, despite more than a year passing since Raja's murder, the government has yet to initiate a CBI investigation into the case. He expressed that their family has long been advocating for a CBI probe into the murder of Raja Raghuvanshi.
