Supreme Court Greenlights Tax Assessments for Sons of Former Chief Justice YK Sabharwal
Supreme Court's Ruling on Tax Assessments
New Delhi: The Supreme Court has authorized the income tax evaluations for the two sons of former Chief Justice YK Sabharwal, linked to share transactions that financed their acquisition of a prime property on Sikandra Road in Delhi back in 2010.
A bench comprising Justices JB Pardiwala and K Vinod Chandran rejected four appeals from Chetan and Nitin Sabharwal, affirming the income tax reassessment notices for the fiscal years 2008-09 and 2009-10.
Justice Sabharwal, who served as the 36th Chief Justice of India from November 1, 2005, to January 14, 2007, had an extensive judicial career that included positions in the Delhi High Court, Bombay High Court, and the Supreme Court.
The court noted that the notice issued by the Income Tax Department on March 31, 2015, was based on a legitimate "reason to believe" under Sections 147 and 148 of the Income Tax Act, 1961.
In its judgment delivered on October 28, the apex court stated that the investigation report from the director general provided sufficient evidence for the Assessing Officer to reasonably suspect that taxable income had not been assessed.
The court clarified that "reason to believe" implies a cause or justification, and the officer is not required to conclusively prove the income's escape.
It emphasized that courts should not evaluate the adequacy of the reasons and dismissed claims that overvaluation could not result in escaped income.
"The income escapement concerning the seller of the shares, whose proceeds were later used to acquire capital assets, could be seen as a diversion of income, taxable under the guise of sale proceeds, especially since the sale proceeds were significantly above the actual share value..."
The bench further explained that the case does not suggest that the Assessing Officer acted on mere speculation; rather, it indicated that a thorough investigation was warranted.
In October 2007, the Sabharwal brothers, along with two other shareholders, agreed to sell shares of Pawan Impex (P) Ltd and SVIIT Software (P) Ltd to GYS Real Estate Pvt Ltd for Rs 195 crore and Rs 60 crore, respectively, with each seller receiving a quarter share.
Chetan Sabharwal's assessment for 2008-09 was finalized in December 2010, and his reported income was accepted.
However, the Income Tax Department's subsequent investigation raised alarms regarding the share valuations, indicating that the sale price was disproportionately high compared to the actual value of the underlying land and buildings.
The department also discovered that a significant portion of the proceeds was utilized to purchase a property on Sikandra Road in April 2010, with the brothers claiming a capital gains tax exemption under Section 54F of the Income Tax Act.
