Supreme Court Criticizes Government Over Minor's Abortion Case
Court's Strong Reprimand to the Government
On Thursday, India's Supreme Court delivered a stern rebuke to the central government regarding a case involving a 15-year-old rape survivor who is 31 weeks pregnant. The court emphasized that in such sensitive situations, the ultimate decision rests solely with the victim and her family, not the government. The bench, led by Chief Justice Surya Kant, expressed strong objections to a 'curative petition' filed by the government, which challenged a previous court order allowing the minor to terminate her pregnancy.
Respect for Citizens' Rights
During the proceedings, the Chief Justice interrupted the lawyer representing the government, stating, "Respect the citizens, Madam... you have no right to challenge this. That right belongs only to the victim or her family."
Acknowledging the Trauma
The bench, visibly emotional, remarked that no compensation could alleviate the trauma and mental anguish endured by the minor.
Need for Parental Involvement
Justice Joymalya Bagchi also questioned the government's stance, asserting, "We respect personal choices, and you should too..." The court stated that parents should be informed medically and allowed to decide what is best for their child's physical and mental health.
Revisiting Time-Bound Laws
In a significant observation, the court suggested that existing laws may require amendments. It stated, "When pregnancy results from rape, there should be no time limit. The law must be flexible and adapt to changing times."
Government's Concerns Addressed
Legal representatives for the government argued that terminating the pregnancy at this stage could pose risks. They proposed that the minor could carry the pregnancy to term and consider adoption. However, the court disagreed with this perspective, highlighting the emotional and psychological impact on the victim.
Allowing Dignity for the Minor
During the hearing, the bench made a powerful statement, saying, "If this has become a battle between a girl and a fetus, the girl should be allowed to live with dignity." The court stressed that the teenager should focus on her future rather than being forced into motherhood after such trauma.
Previous Court Order on Abortion
The Supreme Court had previously granted the minor permission to medically terminate her pregnancy, considering the severe mental stress and impact on her life. The court noted that forcing her to continue the pregnancy would violate her right to live with dignity.
