Conditional Bail Granted to Sonal Raghuvanshi
Sonal Raghuvanshi, the primary suspect in the Raja Raghuvanshi murder case, has been granted bail under specific conditions. She is required to remain in Meghalaya and report to the police station regularly. Additionally, Sonal must provide a personal bond of ₹50,000 along with two sureties. She is also mandated to attend all court hearings, refrain from tampering with witnesses or evidence, and not leave the jurisdiction without court approval.
Brother's Statement on Family Relations
In a recent statement, Sonal's brother, Govind, clarified that the family is not involved in the case. He mentioned that Sonal has been assigned a government lawyer and emphasized that they will never bring her back to their home in Indore.
Court's Remarks on Arrest Procedures
The court noted that during her arrest, the police failed to adequately inform Sonal of the charges against her. According to the court, the arrest documents provided by the police contained significant errors, including a lack of proper reference to the murder allegations.
The court affirmed that it is a constitutional right for any accused to be clearly informed of the reasons for their arrest. Failure to do so renders the arrest process legally flawed. Citing previous Supreme Court rulings, the court stressed the necessity of clearly stating the grounds for arrest.
Trial Delays and Witness Statements
Sonal has been incarcerated for nearly ten months. Although a charge sheet has been filed, only four out of ninety witnesses have provided their statements so far. The trial process has been further delayed due to the submission of a supplementary charge sheet and the addition of new accused individuals. The court remarked that the delays in the trial were not the fault of the accused, thus she cannot be held in custody indefinitely.
Government Lawyer's Opposition to Bail
The government lawyer opposed the bail, arguing that the mistakes made during the arrest were merely technical and that Sonal was aware of the charges. However, the court rejected this argument, stating that the necessary legal procedures were not properly followed at the time of her arrest.
