Monday marked a crucial turning point in Bihar's political landscape as Chief Minister Nitish Kumar and BJP National President Nitin Naveen both resigned from their respective legislative positions. This development signals the onset of a new political chapter in the state.
Both leaders stepped down from the Bihar Legislative Council and the Bihar Assembly, respectively, following their recent election to the Rajya Sabha.
Resignation Process
Interestingly, neither Nitish Kumar nor Nitin Naveen submitted their resignations in person; instead, they utilized representatives to deliver their letters. Nitish Kumar's resignation was handed over by MLC Sanjay Gandhi, accompanied by Parliamentary Affairs Minister Vijay Kumar Chaudhary, to the Chairman of the Council. Meanwhile, Nitin Naveen's resignation letter was presented to the Assembly Speaker by BJP State President Sanjay Sarawagi.
The Chairman of the Legislative Council, Avadhesh Narayan Singh, accepted Nitish Kumar's resignation and praised him, stating that he has been a dedicated leader who consistently prioritized the interests of Bihar.
Legal Obligations and Timeline
On March 16, both leaders were elected to the Rajya Sabha, and according to regulations, they were required to resign from one of their legislative positions by March 30. The Constitution's Articles 101 and 190 clearly state that an individual cannot simultaneously hold membership in both Parliament and a state assembly, necessitating a resignation within 14 days.
Regarding Nitin Naveen's resignation, Sanjay Sarawagi explained that Naveen had already submitted his resignation prior to leaving Patna due to prior commitments in Delhi and Assam, which was formally presented to the Speaker on Monday.
Emotional Messages and Future Speculations
Naveen also expressed a heartfelt message to the residents of the Bankipur area, stating that while the party has entrusted him with new responsibilities, his connection with the people will remain strong. On the other hand, Vijay Kumar Chaudhary mentioned that Nitish Kumar had also submitted his resignation to Sanjay Gandhi earlier, which was now officially filed.
Chaudhary emphasized that Nitish Kumar has always adhered to constitutional values, and this decision aligns with that tradition. The pressing question now is when Nitish Kumar will resign from the Chief Minister's position. Chaudhary refrained from providing a direct answer, indicating that everything will occur at the appropriate time and in accordance with the Constitution. However, it is widely believed that Kumar may step down before taking the oath in the Rajya Sabha.
