Sharjeel Imam Granted Limited Interim Bail for Family Wedding
Sharjeel Imam's Release on Interim Bail
Sharjeel Imam, accused in the 2020 Northeast Delhi riots case, has been released from prison today after nearly six years. A local court granted him interim bail for a limited period, allowing him to attend his younger brother's wedding and visit his ailing mother. This decision was made by Additional Sessions Judge Sameer Bajpai at the Karkardooma court on March 9.
The court has approved a total of 10 days of interim bail for Sharjeel Imam, effective from March 20 to March 30, 2026. To secure this relief, the court required a personal bond of ₹50,000 along with two sureties of the same amount. Additionally, several strict conditions were imposed during the bail period.
Details of the Bail Application
Sharjeel Imam had requested six weeks of interim bail, citing his younger brother Mujammil Imam's wedding scheduled for March 25. His defense attorney argued that as the elder brother, Sharjeel's presence was essential for various wedding ceremonies planned between March 22 and March 28. The application also highlighted that Sharjeel's mother is unwell and primarily relies on his younger brother for care, which could be compromised due to wedding preparations, necessitating Sharjeel's presence.
Opposition from Prosecution
However, the prosecution opposed this request, stating that the wedding arrangements had already been completed and Sharjeel's presence was not crucial. They also pointed out that his previous bail applications had been rejected by lower courts, the Delhi High Court, and the Supreme Court. The prosecution expressed concerns that if released, Sharjeel might tamper with evidence or influence witnesses. After considering arguments from both sides and verifying facts related to the wedding, the court decided to grant only 10 days of limited relief instead of the requested six weeks.
Conditions of Interim Bail
The court laid down several clear directives for the interim bail period. Sharjeel Imam is prohibited from contacting any witnesses or individuals related to the case. He must provide his mobile number to the investigating officer and keep it active at all times. Furthermore, he has been instructed to refrain from interacting with the media and using social media. Additionally, during the bail period, Sharjeel is only allowed to meet family members and must either remain at his residence or attend the wedding venues.
Return to Custody
The court also clarified that Sharjeel Imam must surrender to the jail superintendent by the evening of March 30. Following this, a compliance report will be submitted by the relevant authorities. It is important to note that this case is linked to the riots in Northeast Delhi in February 2020, which resulted in over 50 fatalities and more than 700 injuries. According to the Delhi police, this violence was part of a planned conspiracy against the backdrop of protests against the Citizenship Amendment Act.
Legal Perspectives on the Court's Decision
The court's ruling is viewed as a limited relief granted on humanitarian grounds, attempting to balance judicial processes with family circumstances. However, legal experts caution that such relief could potentially lead to significant complications if misused.
