Legal Petition Filed in Supreme Court

A private real estate company based in Jaipur has filed a petition in the Supreme Court, alleging unauthorized commercial activities on land designated for residential use in the city. The firm is requesting the Jaipur Municipal Corporation (Greater) to investigate the matter and take appropriate legal action. This petition is part of an ongoing case, Lognathan vs. State of Tamil Nadu and Others, where the Supreme Court directed municipal bodies in all state capitals in March to identify residential areas allegedly being used for commercial purposes and to submit compliance reports.


Claims of Exclusive Development Rights

Through its petition, Rajdarbar Pinkcity Developments Private Limited aims to include its dispute regarding the alleged unauthorized commercialization of residential areas in the Supreme Court's ongoing investigation. The company claims exclusive development rights over a specific plot of land located in Chimampura village, Bhankrota district of Jaipur. It alleges that several commercial establishments, including furniture outlets, boutiques, salons, eateries, and clothing stores, are operating on this land, violating the approved residential land use designation.


Previous Appeals and Lack of Action

The company stated that this land was designated for the development of a private residential township under the Rajasthan Township Scheme, with its development rights recognized through orders passed by the Jaipur Development Authority (JDA) in 2005. In its submissions, the developer has claimed that despite multiple representations, proceedings before the JDA Appellate Tribunal, and orders from the Rajasthan High Court to consider its complaints, no effective action has been taken against the unauthorized constructions and commercial activities. The application mentions that the company approached the JDA Appellate Tribunal in January 2025, seeking action against the alleged unauthorized structures. In May 2025, the tribunal reportedly ordered a site inspection and directed appropriate legal action if any illegal constructions were found. Following this, the company submitted representations to the Jaipur Municipal Corporation (Greater) and subsequently approached the Rajasthan High Court.


Awaiting Decision from Authorities

According to the developer, the Rajasthan High Court instructed the relevant municipal officials on February 4, 2026, to make a decision on their representations within two months through a reasoned order. The company alleges that no decision has been communicated within the stipulated timeframe and has indicated that it is considering further legal options.
