Background of the Case

This case emerged from a habeas corpus petition filed by the woman's husband, Avadhesh. His lawyer, Suresh Pal Singh Gurjar, claimed that the woman was being held unlawfully by a man named Anuj Kumar. Initially, the police had placed her in a one-stop center. During the hearing, the court summoned the woman, along with her parents, husband Avadhesh, and boyfriend Anuj Kumar.

Woman's Testimony in Court

Justices Anand Pathak and Pushpendra Yadav inquired about her wishes. The young woman confidently stated that she is an adult and is making her own choices. She clarified that she was not being held against her will or under any pressure. She expressed her desire not to live with her husband, who is 40 years old, citing the significant age gap as a barrier to emotional connection and marital harmony.

Counseling and Support

The woman also mentioned experiencing mistreatment while living with her husband. The court arranged for her counseling, where government advocate Anjali Gyanani spoke with her. Despite the counseling, she remained firm in her decision to live with Anuj Kumar, who assured the court in writing that he would take good care of her and ensure her well-being.

Final Verdict

After hearing from all parties involved, the High Court concluded that the woman is an adult making her own decisions, thus rendering the petition moot. The court granted her permission to move in with Anuj Kumar and established two key arrangements for her safety. Government advocate Anjali Gyanani and lady constable Bhavna were appointed as 'Shaurya Didi' for six months to ensure her safety and guidance. The court also ordered her release from the one-stop center in Gwalior after completing all necessary formalities. This ruling effectively concluded the petition.
