The Gwalior High Court has made a notable decision by allowing a 19-year-old woman to reside with her boyfriend, acknowledging her as an adult. To ensure her safety, the court appointed a 'Shaurya Didi' for a period of six months.

This unusual case emerged in the Gwalior High Court, where the young woman expressed her unwillingness to continue her marital life with her 40-year-old husband. The significant age gap led to a lack of understanding and happiness in their relationship. The woman clearly stated her desire to live with her boyfriend.


Details of the Petition

The case was linked to a habeas corpus petition filed by her husband, Avadhesh. His lawyer, Suresh Pal Singh Gurjar, claimed that the woman was being held unlawfully by a man named Anuj Kumar. Initially, the police had placed her in a one-stop center. During the hearing, the court summoned the woman, along with her parents, husband, and boyfriend.


Woman's Testimony in Court

Justices Anand Pathak and Pushpendra Yadav inquired about her wishes. The young woman confidently asserted that she is an adult and is making her own choices. She stated that she was neither being held against her will nor under any pressure. She expressed her unwillingness to live with her husband, citing the 21-year age difference as a barrier to emotional connection and marital harmony.


Counseling Session

She also mentioned experiencing mistreatment while living with her husband. The court arranged for her counseling, where government advocate Anjali Gyanani spoke with her. Despite the counseling, the woman remained firm in her decision to live with Anuj Kumar, who provided a written assurance to the court regarding her care and well-being.


Court's Decision

After considering all perspectives, the High Court concluded that the woman is an adult capable of making her own decisions. Consequently, the purpose of the petition was deemed fulfilled. The court granted her permission to move in with Anuj Kumar and appointed two officials, Anjali Gyanani and lady constable Bhavna, as 'Shaurya Didis' for six months to ensure her safety and guidance. The court also ordered her release from the one-stop center in Gwalior after completing the necessary formalities.
