Gauhati High Court Delays Decision on Shyamkanu Mahanta's Bail Request
Court Reserves Verdict on Bail Application

Guwahati, May 25: The Gauhati High Court has once again postponed its decision regarding the bail application of Shyamkanu Mahanta, a primary suspect in the murder case of Assam's cultural figure, Zubeen Garg. The court is anticipated to announce its ruling on May 29.
According to Additional Public Prosecutor Bojendro Mohan Choudhury, the court has heard arguments from both parties involved. He stated, “We contended that bail should not be granted. After considering both arguments, the court may deliver its verdict on May 29, or it might take an additional two to three days.”
Choudhury emphasized that the case is characterized by a “pre-planned murder,” asserting that the evidence currently available bolsters the prosecution's stance against Mahanta.
“Upon reviewing the evidence, the High Court noted that the material supports the prosecution's claims and that bail should not be granted at this time. The court also highlighted the risk of Mahanta fleeing, as he reportedly traveled to Malaysia shortly after the incident,” the advocate explained.
Furthermore, Choudhury mentioned that Zubeen’s nephew accused Mahanta of using coercive tactics to persuade him to go to Singapore.
“Zubeen’s nephew recounted how Zubeen was allegedly treated as a mere commodity. He claimed that Shyamkanu exerted emotional pressure, suggesting that if Zubeen did not participate in shows, he would take drastic measures. It is well-known that Zubeen worked tirelessly to foster peace and unity among people,” Choudhury added.
Previously, on May 13, the hearing regarding Mahanta’s bail request could not proceed as Justice Parthivjyoti Saikia recused himself from the case.
The petition was scheduled as item number five on Justice Saikia’s agenda for final hearing that day. Special Public Prosecutor Ziaul Kamar confirmed that the judge opted not to hear the case.
