Court Ruling on Defamatory Social Media Content


On Tuesday, the Delhi High Court mandated the removal of social media posts deemed defamatory towards Surinder Kumar Choudhary, the Deputy Chief Minister of Jammu and Kashmir.


Choudhary initiated a defamation lawsuit on December 2, claiming that a video circulating on platforms like Facebook and YouTube featured his image and contained inappropriate sexual implications.


He asserted that the voice in the video was misattributed to him, which he firmly denied. The Deputy CM argued that the video was disseminated with the intent to tarnish his reputation and sought a permanent injunction against it.


Justice Amit Bansal remarked that, upon initial review, there appeared to be sufficient grounds for Choudhary's claims.


The court has scheduled further hearings for April 2026.


Previously, on December 9, the High Court instructed Choudhary to include those responsible for uploading the contentious material in his lawsuit.


Additionally, the court noted that Choudhary had not submitted transcripts of the disputed content, which are necessary for determining whether it is indeed defamatory.
