High Court's Notice to CBI

The Delhi High Court has issued a notice to the Central Bureau of Investigation (CBI) regarding the regular bail application of former Uttar Pradesh police inspector Jagat Narayan Singh. He was arrested in connection with the death of businessman Manish Gupta in Gorakhpur in 2021. The court has requested a status report and scheduled the next hearing for August 13. This case pertains to the alleged beating of Manish Gupta by Uttar Pradesh police personnel at a hotel in Gorakhpur on September 27, 2021, which reportedly led to his death due to injuries sustained.


Details of the Case

Due to the involvement of police officers, the investigation was transferred to the CBI and the trial moved to New Delhi following a Supreme Court order. Jagat Narayan Singh approached the High Court for regular bail through his lawyer, Kanhaiya Singhal. Justice Manoj Jain has issued a notice to the CBI seeking a response, and a nominal roll has also been requested.


Legal Proceedings

Lawyer Ripudaman Bhardwaj accepted the notice and requested time to submit the status report. Six police officers are accused in this case, one of whom challenged the charges set by the trial court in January 2023. The High Court dismissed a petition filed against the framing of charges in September 2023. Jagat Narayan Singh filed a petition seeking to quash the orders related to charges issued on January 9 and January 13, 2023, under various sections of the IPC, including 302, 323, 325, 201, 218, 149, 34, and 120B.


Court's Ruling

Justice Jasmeet Singh dismissed the petition, stating, "I believe that the relevant special judge has correctly understood the facts and law of the case and has appropriately examined the material presented before them." In the ruling given on September 27, Justice Singh noted that there was no indication in the post-mortem report of the deceased Manish Gupta that the injuries were insufficient to cause death under normal circumstances. However, the revisionist will have the opportunity to cross-examine the doctors regarding their opinions.
