When questioned by the judges about her desires, the woman expressed her wishes without hesitation. She discussed her marriage and the 21-year age gap, stating that she was 19 and her husband was 40. She described a relationship that lacked harmony and accused her husband of mistreatment.
Her decision was resolute; she wanted to live with her partner. The court ordered counseling to give her a chance to reconsider her choice, but her stance remained unchanged.
After the counseling sessions, the woman stood firm in her decision. Her partner assured the court that he would take full responsibility for her well-being and safety. The division bench, comprising Justice Anand Pathak and Justice Pushpendra Yadav, ruled that the woman's voice was paramount.
