Court Rules on Sharjeel Imam's Request for Study Material Access

The Karkardooma Court in Delhi addressed Sharjeel Imam's petition on Monday, stating that the authority to control and monitor the material on the pen drive lies solely with the jail superintendent. The court decided to leave the consideration of Imam's request to the discretion of the jail superintendent. Imam sought access to study materials stored on a pen drive to complete his PhD thesis.

Additional Sessions Judge (ASJ) Sameer Bajpai remarked that only the prison administration can oversee the applicant's use of the material, and the court's decision on the request is contingent upon the jail superintendent's approval.

Sharjeel Imam submitted this petition through his lawyer, Ahmed Ibrahim, requesting permission to utilize the research material on the pen drive so he could work on his PhD while incarcerated. Imam's lawyer noted that the previous superintendent of Jail Number 1 had allowed him to keep necessary materials on the pen drive, which he had used. However, the current superintendent has denied him permission to store and use the material. In response, the deputy superintendent stated that if the material were in the form of books, printouts, or photocopies, it would pose fewer issues. However, data stored on a pen drive can be extensive, making censorship challenging for the prison administration.

The court indicated that providing books and similar materials would not pose any issues, but it would not have control over the material on the pen drive. The ruling stated, "In this case, only the prison administration can manage and monitor the applicant's use of the material, and the court leaves the decision regarding the applicant's request to the discretion of the jail superintendent." Sharjeel Imam is accused in a case related to the alleged larger conspiracy behind the Delhi riots of 2020. Following the trial court's rejection of his bail on July 4, he has recently approached the High Court.
