Sonam Raghuvanshi, accused of murdering her husband during their honeymoon in Meghalaya, has been granted bail by the court. This high-profile case's outcome was not due to a lack of evidence but rather a 'typing error' made by the police.
Non-Existent Section: 403 Instead of 103
A Meghalaya court discovered that the police had referenced a section of the Indian Penal Code (IPC) in Sonam's arrest memo and other legal documents that does not actually exist.
Error Analysis: The police cited section 403(1) in their documents, while the correct section for murder under the new code (IPC) is 103(1).
Court's Reasoning: Although the police labeled this as a 'clerical mistake,' the court dismissed this argument. The judge stated that if the arrest memo contains an incorrect section, it implies that the accused was not informed of the 'solid grounds for arrest.'
Court's Conclusion: "There is no section 403(1) in the Indian Penal Code (IPC). Therefore, this arrest cannot be deemed legally valid."
Further Legal Missteps Identified
According to the court's order, Sonam Raghuvanshi's arrest memo, investigation memo, rights notification memo, and even the case diary entries referenced a non-existent section 403(1) of the IPC.
The court rejected the police's claim that this was merely a 'clerical error,' stating that the accused was not informed of the 'solid grounds for arrest,' rendering the arrest legally invalid.
Lack of Access to Legal Counsel
The court also pointed out another significant oversight. It noted that there was no evidence in the records to show that Sonam was given the opportunity to meet with a lawyer or seek legal advice when she was first presented in the Ghazipur court after her arrest.
Conditions of Bail
When granting bail, the court imposed certain conditions. It instructed that Sonam must not leave the Shillong district without prior permission.
Sonam's brother, Govind Raghuvanshi, mentioned that the family is still awaiting the written order from the court. They are uncertain whether Sonam will be released immediately and what arrangements will be made for her accommodation post-release.
"I have also learned that Sonam has been granted bail, but we are still waiting for the written order from the court. I do not know when she will be released and where she will stay after that," he stated.
He further added that the family might not take Sonam home immediately. "If my parents want to bring her home, I will not be there."
Background of the Case
Sonam Raghuvanshi is accused of conspiring to murder her husband, Raja Raghuvanshi, during their honeymoon in Meghalaya. The couple married in May 2025 and traveled from Indore to Shillong. A few days later, Raja went missing, and his body was discovered in a ravine on June 2.
The police allege that Sonam conspired with several individuals in this murder. Eight suspects have been arrested in this case, three of whom have already been granted bail.
Given the serious flaws identified in the arrest process by the court, this case now faces a legal challenge that could significantly influence its direction, even as the investigation continues.
