Political and Legal Controversy Arises from Bihar Encounter

A police encounter in the Bhojpur district of Bihar has ignited a significant political and legal controversy across the nation. On June 17, Bharat Bhushan Tiwari, a 26-year-old resident of Bilauti village, was reportedly killed during an alleged police shootout. This incident has raised serious questions regarding the operational methods of the Bihar police. While the police label him as a criminal, local residents and his family regard him as a 'messiah' who raised public issues. The matter has escalated to the Supreme Court, making it a highly sensitive case.


Details of the Encounter

According to police reports, Tiwari allegedly opened fire on officers with an illegal weapon when they attempted to arrest him. The police claimed they returned fire in self-defense, resulting in Tiwari being injured. He was subsequently taken to a hospital, where he succumbed to his injuries.


Family's Allegations Against Police

Tiwari's family has vehemently opposed the police's account, asserting that he had surrendered and discarded his weapon before the shooting occurred. They also claim that viral videos circulating on social media show Tiwari unarmed when the police fired at him.


Supreme Court Petition Filed

A petition has been submitted to the Supreme Court, requesting the formation of an independent expert committee led by a former judge to investigate the alleged 'extra-judicial killing' of Bharat Bhushan Tiwari during the police encounter.


Call for CBI Investigation

The petition also demands an investigation by the Central Bureau of Investigation (CBI), arguing that the circumstances surrounding the encounter necessitate an immediate, independent, and impartial inquiry.


Who Was Bharat Tiwari?

Bharat Bhushan Tiwari was known in his community for raising awareness about local issues through social media. He often highlighted problems related to floods, river erosion, displacement, and the struggles of local communities.


Family's Perspective on Tiwari

According to his family, Tiwari had no criminal record and utilized platforms like Facebook to draw attention to civic and environmental issues. They described him as a social activist dedicated to the welfare of the underprivileged.


Action Against Police Personnel

In light of the growing controversy surrounding the encounter, disciplinary action has been initiated against several police officers. Additional Director General (ADG) Sudhanshu Kumar stated that a police team had approached Tiwari the day before the encounter but failed to manage the situation appropriately. Consequently, one Station House Officer (SHO), two Sub-Inspectors (SI), one Assistant Sub-Inspector (ASI), and one Constable have been suspended.


Investigation Oversight

Kumar further mentioned that the Deputy Inspector General (DIG) of the Shahabad range has been authorized to investigate the matter. Additionally, the Bihar police have decided to have the case examined by a retired judge from the High Court. Two FIRs have already been filed in connection with this incident.


Mother's Plea for Justice

Bharat Tiwari's mother, Asha Devi, alleged that her son was shot twice and claimed he was targeted due to his social service efforts. She stated, "My son was shot twice. He was a good person who worked for society and was a messiah for the poor. His murder was a result of his social work." Asha Devi held a senior police officer accountable, demanding the death penalty for the DSP, expressing that no one is listening to their plea for justice.
