Serious Allegations Lead to Expulsion

The President of the Kerala Pradesh Congress Committee, Sunny Joseph, announced on Thursday that suspended MLA Rahul Mamkuthathil has been expelled from the Congress party following serious allegations against him and related registered cases. The Thiruvananthapuram Principal Sessions Court has also rejected Mamkuthathil's plea for anticipatory bail in a rape case.


 


Based on a woman's complaint, the police have filed charges against MLA Rahul Mamkuthathil for sexual harassment, rape under the pretense of marriage, and forced abortion.

The FIR, initially registered at the Nedumangad Valayamala police station, was later transferred to the Nemom police station as the alleged incidents occurred within its jurisdiction. This case has been filed under eight non-bailable sections of the Indian Penal Code (IPC) 2023, including Section 64 for rape, Section 64(2) for repeated rape of the same woman, Section 64(F) for rape by a trusted person, Section 64(H) for rape knowing the woman is pregnant, and Section 64(M) for repeated rape of the same woman.

Additionally, the case includes charges under IPC Section 89 for conducting an abortion without the woman's consent, Section 316 for criminal betrayal, and Section 68(E) of the Information Technology Act concerning the transmission of objectionable digital content. The penalties for these offenses can range from ten years to life imprisonment. This action follows a written complaint submitted by the victim to Chief Minister Pinarayi Vijayan. After the Chief Minister forwarded the petition to ADGP H. Venkatesh, a senior-level meeting was convened at the police headquarters to determine further action. Following the FIR, the police have initiated the process for the MLA's arrest.
