Response to Supreme Court Decision

Meenakshi Natarajan, the Congress candidate for the Rajya Sabha from Madhya Pradesh, expressed strong discontent after the Supreme Court dismissed her petition challenging the rejection of her nomination papers. She labeled the ruling as a setback for democracy and the Constitution of India. Speaking to the media, Natarajan emphasized that this was not a personal blow but rather an assault on democratic principles and constitutional integrity.


She pointed out that the Election Commission had failed to respond for 48 hours, while the Supreme Court at least heard her plea.


Allegations Against the Election Commission

Natarajan reiterated that the issue was not just about her candidacy but raised serious concerns regarding the impartiality of the Election Commission. She accused the commission of not being fair and highlighted that when her team approached them, they received no response for two days. The Supreme Court's decision to hear her case was a small relief, she noted.


Later, in an interview, she refrained from commenting on the Supreme Court but acknowledged the known stance of the Election Commission. The controversy began when the returning officer rejected her nomination for one of the three Rajya Sabha seats from Madhya Pradesh, citing her failure to disclose a pending criminal case.


Legal Proceedings and Future Steps

Following the rejection, senior Congress leaders approached the Election Commission to demand an immediate reversal of the decision, which led to the party taking the matter to the Supreme Court.


Previously, the Supreme Court stated that it was not inclined to consider the petition and dismissed it, clarifying that its comments regarding Natarajan's nomination would not affect any election petition that could be filed in the High Court. Senior advocate Abhishek Manu Singhvi, representing Natarajan, argued that the allegations against her had not been formally charged, which is a necessary condition for disqualifying a nomination under the Representation of the People Act (RoP).
