Calcutta High Court Denies Interim Relief in TMC Leadership Dispute
Political Turmoil in West Bengal Reaches Court
The political landscape in West Bengal has intensified, with the ongoing power struggle now spilling into the judicial arena. The Calcutta High Court delivered a significant legal setback to Mamata Banerjee, the leader of the Trinamool Congress (TMC), by refusing to impose an interim stay on the state assembly speaker's decision that recognized rebel TMC MLA Ritabrata Banerjee as the Leader of the Opposition (LoP).
As a result of the court's decision, Ritabrata Banerjee will continue to hold his position, and the speaker's ruling by Rathin Basu remains fully effective.
Court Proceedings and Future Hearings
Justice Krishna Rao indicated that the next hearing in this matter is scheduled for July 28, instructing all parties to submit their affidavits before the upcoming date.
The court's order stated, "This court finds no prima facie case or balance of convenience to issue an interim order in favor of the petitioner, thus denying the request for such an order."
Background of the Dispute
The petitioner, TMC MLA and close associate of Mamata Banerjee, Shovandev Chattopadhyay, approached the Calcutta High Court seeking an interim stay on the speaker's decision.
During the proceedings on Wednesday, the court questioned Additional Advocate General Bilvadal Bhattacharya regarding the speaker's delay in addressing a letter received on May 9, which proposed Shovandev Chattopadhyay as the LoP.
Speaker's Actions Under Scrutiny
The court noted that the speaker had not acted on the initial application but had declared Ritabrata Banerjee as the LoP based on a letter received from the rebel faction on June 3.
The court further inquired why there was no explanation from the speaker regarding the disregard of the first application while the second was accepted almost immediately.
Impact of Recent Elections
Following a significant defeat in the assembly elections, the TMC has experienced a split within its legislative party, with many members turning 'rebel'. The party leadership had proposed Shovandev Chattopadhyay as the leader of the legislative party. However, disregarding this decision, Ritabrata managed to garner support from 58 MLAs and assumed the role of Leader of the Opposition.
Earlier, on June 1, the TMC leadership had decided to expel Ritabrata from the party due to allegations of 'anti-party activities'.
