Nitish Kumar Steps Down from Legislative Council
On Monday, Bihar's Chief Minister Nitish Kumar announced his resignation from the state's Legislative Council following his election to the Rajya Sabha, as reported by a news source.
March 30 marked the final opportunity for Kumar to resign as a member of the Legislative Council after being elected to the Upper House of Parliament on March 16 for the first time. His current term in the Legislative Council, which is his fourth consecutive term, was set to conclude in 2030.
According to the 1950 Prohibition of Simultaneous Membership Rules, an individual elected to both Parliament and a state legislature must resign from one within 14 days. If this is not done, their parliamentary membership will be automatically revoked.
Kumar will continue to serve as chief minister for the time being, as Article 164(4) of the Constitution allows an individual to hold this position for up to six months without being a member of the state legislature.
The leader of the Janata Dal (United) party took office as chief minister for the tenth time in November following the Assembly elections.
When he announced his candidacy for the Rajya Sabha elections on March 5, Kumar expressed his aspiration to fulfill all four legislative roles at both state and central levels, including being a member of the Legislative Assembly, Legislative Council, Lok Sabha, and Rajya Sabha.
Currently serving in the Legislative Council, Kumar has also held positions as a member of the Legislative Assembly and as a Lok Sabha MP in the past.
There has been speculation regarding his potential resignation from the chief minister position after his election to the Rajya Sabha, but it remains uncertain who might succeed him and when this change will occur.
