Guwahati, Nov 18: Chief Minister Himanta Biswa Sarma announced on Tuesday that the Ministry of Home Affairs (MHA) has finally approved the investigation into the death of Zubeen Garg. This announcement coincided with what would have been the late artist's 53rd birthday.
Sarma revealed that Union Home Minister Amit Shah has granted the necessary sanction under Section 208 of the Bharatiya Nagarik Suraksha Sanhita (BNSS), which is essential for Indian courts to address crimes that occur outside the nation.
He explained that without prior approval from the Central Government, courts cannot proceed with cases involving crimes committed abroad. This sanction is a vital legal step, enabling the authorities to file a charge sheet and advance the case towards trial.
Earlier this month, the investigation took a decisive turn when, on November 3, the Chief Minister publicly labeled Garg's death as a 'murder,' asserting that the Special Investigation Team (SIT) had gathered sufficient evidence to proceed.
According to previous remarks from Sarma, the SIT had nearly completed all necessary procedures, including obtaining the post-mortem and toxicology reports from Singapore, and was poised to file the chargesheet pending MHA approval.
To clarify the legal proceedings, SIT chief Munna Prasad Gupta mentioned that if necessary, individuals interviewed during the investigation might be summoned back from Singapore for additional questioning.
Gupta assured the media that the required approval to advance the trial has been secured. He noted that the case remains under investigation, and further inquiries may be conducted if needed.
So far, approximately 160 witnesses have been called for questioning.
Gupta emphasized the procedural nature of the approval, stating that it is essential for progressing with the legal case. The team has submitted substantial evidence for forensic analysis and has received reports in return.
Authorities have arrested seven individuals in connection with the case, including Shymakanu Mahanta, the organizer of the North-East India Festival (NEIF), and Garg's manager, Siddhartha Sarma.
Gupta reiterated the Chief Minister's commitment to filing the chargesheet following the approval, indicating that the investigation is moving forward efficiently. 'We aim to file the chargesheet by December 10,' he confirmed.
