Amritpal Singh's Current Status
Amritpal Singh has been detained under the stringent National Security Act (NSA) and has been incarcerated in Dibrugarh Jail, Assam, since 2023. His attorney, Iman Singh Khara, reported that Singh wrote to the Lok Sabha Speaker earlier in the day, detailing the reasons for his absence and requesting an apology from the House. Earlier, the Additional Solicitor General of India, Satya Pal Jain, informed the High Court that there is no 'immediate threat' to Singh's seat. Jain also mentioned that the MP must submit a written application for leave due to his absence, which has now extended to 59 days, with today marking the 60th day. He must formally apply for leave, which is typically granted, and officials have already informed him about this process.
Implications of Extended Absence
According to Jain, if an MP is absent for more than 60 days, their seat may be declared vacant. However, he clarified that if the MP applies for leave to the designated committee of the Lok Sabha, the committee may consider it. Jain noted that absences due to medical reasons, accidents, or detention under the NSA are generally reviewed by the parliamentary committee and are often approved. He added that Singh's absence has already been excused on two previous occasions. This information was shared during the hearing of a petition filed by Amritpal Singh on February 11, challenging the Punjab government's order that rejected his request to participate in the parliamentary budget session, which is being held in two phases from January 28 to February 13 and from March 9 to April 2.

The Punjab and Haryana High Court has reserved its decision regarding the parole application filed by Amritpal Singh, seeking temporary release to attend the budget session. After hearing arguments from both sides, the court announced its decision following a lengthy debate. Previously, the High Court had reserved its ruling on a petition filed by the Punjab government against the third imposition of the National Security Act (NSA) on March 11, which remains pending.
