Prayagaraj/New Delhi: The Allahabad High Court has recently rejected a petition that sought to challenge a Sambhal court's decision not to register a First Information Report (FIR) against Rahul Gandhi, the Leader of Opposition in the Lok Sabha, regarding his contentious remarks about 'fighting the Indian state.'
Justice Vikram D. Chauhan, presiding over a single-judge bench, dismissed the plea brought forth by Simran Gupta from the Hindu Shakti Dal. Gupta claimed that Gandhi's comments had offended public sentiments across the country and constituted a 'seditious and anti-national' statement.
The remarks in question were made by Gandhi during the inauguration of the All India Congress Committee's new headquarters in New Delhi in January of the previous year. He stated, 'We are now fighting the BJP, the RSS, and the Indian State itself.'
Gupta argued that Gandhi's statements transcended mere political critique, suggesting they were a calculated effort to undermine the nation by depicting the Indian state as an enemy.
This issue escalated to the Allahabad High Court after a local Sambhal court dismissed Gupta's request for an FIR against the Congress leader.
Following the dismissal of a revision plea, Gupta escalated the matter to the High Court.
In his remarks, Gandhi criticized the BJP and the Rashtriya Swayamsevak Sangh (RSS), accusing them of seizing control of national institutions and asserting that the Congress party was defending the Constitution and the essence of India. He warned, 'Do not think we are fighting a fair fight. If you believe this is merely against a political organization like the BJP or RSS, understand that they have captured almost every institution in our country. We are now up against the Indian state itself.'
These comments sparked significant political backlash, with BJP leaders accusing Gandhi of jeopardizing India's sovereignty and constitutional integrity.
Former BJP president J.P. Nadda remarked that Gandhi's statement revealed the 'ugly truth' of the Congress party, claiming it represented an ideological conflict against the nation.
Additionally, an FIR was previously filed against Gandhi at the Pan Bazar Police Station in Guwahati, Assam, under Sections 152 and 197(1)(d) of the Bharatiya Nyaya Sanhita, based on allegations that his remarks incited disaffection towards the State and threatened national unity.
In a separate matter, the Allahabad High Court recently addressed another petition involving Gandhi, where Justice Subhash Vidyarthi recused himself from a case seeking the registration of an FIR over claims of dual citizenship, following controversy surrounding the petitioner's social media posts.
