Court's Decision on the Petition

The Allahabad High Court has declined to entertain a petition from the Samajwadi Party challenging the order for the Peelibheet Municipal Corporation's local office to vacate.


While dismissing the writ petition, the bench comprising Justice Ashwini Kumar Mishra and Justice Jayant Banerjee stated that since the petitioner had already approached a civil court regarding this matter, they cannot seek dual relief.


Previously, on June 16, the Supreme Court had rejected the party's petition against the municipal body's decision and prohibited the Peelibheet district president from filing a new petition in this regard.


The party contends that the municipal authority issued the eviction order on November 12, 2020, without providing them an opportunity for a hearing.
