Tabu Seeks Legal Protection for Personality Rights Against Unauthorized Use

New Delhi, Aug 4: Renowned actress Tabu has filed a petition with the Delhi High Court to safeguard her personality and publicity rights against the unauthorized use of her name, image, likeness, and other identity attributes, particularly in relation to artificial intelligence (AI)-generated content and digital impersonation.
The case was presented before Justice Jyoti Singh, who noted some inconsistencies in the documents submitted on behalf of the actress.
During the hearing, Justice Singh instructed senior advocate Swathi Sukumar, representing Tabu, to submit a revised memo of parties, as the current one inaccurately listed some defendants.
The judge emphasized the importance of having precise details of all parties involved for the effective resolution of the case and ordered the necessary corrections to be made.
As a result, the Delhi High Court postponed further proceedings and scheduled the next hearing for August 6.
Tabu's application highlights her concerns regarding the unauthorized commercial exploitation and misuse of her identity and likeness in the digital realm.
This legal action comes at a time when there is an increasing number of disputes over personality rights in the Delhi High Court, particularly involving claims of AI-generated impersonation, deepfakes, fake endorsements, and unauthorized commercial use of public figures' identities.
This case adds to a growing roster of prominent individuals who have sought to enforce their personality and publicity rights in the Delhi High Court. Recently, former cricketer Gautam Gambhir, ex-India captain Sunil Gavaskar, spiritual leader Sri Sri Ravi Shankar, actors Arjun Kapoor, Allu Arjun, Nagarjuna, Varun Dhawan, Kajol, Aishwarya Rai Bachchan, and Abhishek Bachchan, singer Jubin Nautiyal, filmmaker Karan Johar, podcaster Raj Shamani, Congress MP Shashi Tharoor, and actor Naga Chaitanya have all secured or sought legal protection against unauthorized use of their identity, likeness, or AI-generated representations.
