Supreme Court Encourages Amicable Resolution in Estate Conflict
The Supreme Court of India has intervened in the contentious dispute surrounding the estate of the late industrialist Sunjay Kapur, advocating for a peaceful resolution. This significant development arose during a hearing of a petition filed by his 80-year-old mother, Rani Kapur. The court expressed its concerns regarding the lengthy litigation process, particularly considering her age, and encouraged all involved parties to seek an amicable settlement. This case, which revolves around family assets and business interests, has garnered considerable public attention in recent months.
Supreme Court's Call for Mediation in Sunjay Kapur's Case
During the proceedings, a bench led by Justice J B Pardiwala emphasized the importance of avoiding prolonged legal disputes. The court noted that initiating litigation at such an advanced age may not serve the best interests of the petitioner. It urged the parties to reconsider their stance and pursue a more constructive resolution. Previously, the Delhi High Court had also recommended mediation to all parties involved.
The court highlighted that mediation is the most effective approach, suggesting that all parties convene to resolve the issues comprehensively. It stated that engaging in mediation 'from A to Z' would help prevent unnecessary delays and emotional distress. However, the bench also made it clear that it remains available to hear the case on its merits should mediation not succeed, preserving legal avenues for all parties.
Rani Kapur’s petition seeks to protect her estate, assets, and related matters. She has asked the court to prevent other parties from interfering in these affairs while contesting certain orders issued by the Delhi High Court. Her petition raises alarms about the inadequate protection of the estate and warns of potential asset dissipation. Her legal representatives argued that courts typically grant protective measures in cases involving substantial estates at an early stage.

The core of the dispute centers on the establishment of the Rani Kapur Family Trust. Rani Kapur claims that the trust's structure has effectively removed her control over her assets, which include significant stakes in the Sona Group. She further contends that decisions were made without her informed consent following a stroke she suffered in 2017, resulting in the transfer of assets. The conflict escalated after Sunjay Kapur’s passing last year, with various claims surfacing regarding the control of family wealth and business operations. Concurrent proceedings related to will and inheritance issues are currently ongoing before the Delhi High Court, including matters involving Sunjay Kapur's children from his previous marriage to actress Karisma Kapoor. The case is scheduled to be revisited next week.
