This challenge was initiated by Mumbai activist Santosh Daundkar, who had previously approached the National Green Tribunal (NGT). However, the NGT dismissed his plea in September 2025. On July 14, 2026, a bench comprising Justices Surya Kant, Joymalya Bagchi, and V. Mohan dismissed Daundkar's appeal, choosing not to interfere with the NGT's prior ruling and expressing skepticism regarding the petition's credibility. With this Supreme Court ruling, the CRZ clearance remains intact, enabling the Khans to proceed with their renovation plans, which include adding two residential floors.

Following the NGT's dismissal of the plea, the case was escalated to the Supreme Court, which has now dismissed the petition, allowing the renovation to proceed.
