In a pivotal turn of events, actress Rhea Chakraborty, known for her appearances on reality television, has had her bank accounts unfrozen. These accounts, along with those of her brother Showik and their mother Sandhya, were previously frozen by the Narcotics Control Bureau (NCB) in 2020 amid the investigation into the circumstances surrounding Sushant Singh Rajput’s death. A specialized court in Mumbai has mandated the agency to restore access to these accounts, allowing for transactions to resume. Rhea, who was romantically linked to the late actor, received a clean bill of health from the Central Bureau of Investigation (CBI) last year.
Court's Ruling on Account Freezing
The court's decision to release four bank accounts tied to Rhea, Showik, and their mother was based on procedural errors. Reports indicate that the NCB failed to complete the necessary legal steps under the Narcotic Drugs and Psychotropic Substances (NDPS) Act in a timely manner, which invalidated the account freezes. In a series of rulings issued on Saturday, the court highlighted that the agency did not secure the required approval for freezing the accounts from the relevant authority within the stipulated timeframe, rendering the action legally unsound.
The court emphasized that the law restricts the power to freeze assets and that these regulations were not followed in this case. It described the oversight as significant, stating that without the proper legal order, the applications for freezing the accounts had to be granted. The court also instructed that the accounts be managed according to Reserve Bank of India (RBI) guidelines.
Background of the Account Freezing
After Sushant Singh Rajput's tragic passing in 2020, the NCB launched an investigation into drug-related activities, alleging a widespread drug network within the Bollywood industry. Rhea and others were implicated, leading to a chargesheet that suggested a larger conspiracy. The agency froze the accounts based on claims that Rhea and her brother had ties to drug dealers, which justified their actions. However, the court did not evaluate these allegations, focusing instead on the legal procedures that were not adhered to.
A New Chapter for Rhea Chakraborty
In a previous ruling last year, the Bombay High Court ordered the NCB to return Rhea Chakraborty’s passport, lifting travel restrictions that had been imposed during her bail in 2020. Rhea, who had to seek permission for every international trip, expressed her relief, stating, "Patience was my only passport for the past 5 years. Countless battles. Endless hope. Today, I hold my passport again. Ready for my Chapter 2! Satyameva Jayate." The CBI had also concluded that there was no foul play in SSR’s death, determining it to be a suicide.
