Legal Battle Over 'Hai Jawani Toh Ishq Hona Hai' Sparks Controversy in Bollywood
David Dhawan's Return with Controversial Film
Director David Dhawan is back with his latest film, Hai Jawani Toh Ishq Hona Hai, featuring Varun Dhawan, Mrunal Thakur, and Pooja Hegde. The film includes a reimagined version of the classic song Chunnari Chunnari from the 1999 film Biwi No 1. The rights to this song are held by Vashu Bhagnani’s Puja Entertainment, the production company behind the film. Upon discovering the new version, Puja Entertainment took legal action. On May 13, the company received important interim protection from the Court of Civil Judge (Senior Division)-I in Katihar, addressing unauthorized use and commercial exploitation of its valuable intellectual property rights related to several iconic Bollywood films and music catalogs.

Following the court's decision, Vashu Bhagnani expressed his disappointment, stating he had intended to collaborate on multiple projects with David Dhawan after the release of Prime Video’s Coolie No 1, which starred Varun and Sara Ali Khan. He recalled that the Dhawan family had previously inquired about the rights to Chunnari Chunnari and other songs. Initially, they assured him they were not remaking Biwi No 1. However, a year later, the song was filmed with Varun, Mrunal, and Pooja. Vashu mentioned that when his son, Jackky Bhagnani, contacted Rohit Dhawan, Varun's elder brother, Rohit denied any involvement. When they approached Varun, he reportedly said, “What can we do with this song? The producer asked us to make it.” Vashu firmly stated that the filmmakers should have sought his permission, questioning the ethics of using his songs without consent. This prompted him to take legal action.

Puja Entertainment is committed to taking all necessary legal measures to protect its intellectual property and creative assets.
