Court Orders Asset Preservation


New Delhi: On Thursday, the Delhi High Court mandated the preservation of the assets belonging to the late Sunjay Kapur. The ruling came in response to concerns raised by his children from his marriage to actress Karisma Kapoor, who argued that all 'suspicious circumstances' surrounding their father's purported last will must be clarified by his first wife, Priya Kapur, before it can be validated.


Justice Jyoti Singh issued the interim order following an application from Karisma Kapoor's children, seeking to prevent Priya Kapur from disposing of their father's assets, which are estimated to be worth around Rs 30,000 crore.


The application was part of a larger suit filed by the children, contesting the legitimacy of their late father's will.


"After reviewing the evidence presented, I believe that all legitimate concerns raised by the plaintiffs must be addressed by the defendant (Priya Kapur) before the will can be recognized as valid," the judge stated.


"The plaintiffs have established a prima facie case that the assets in question need protection and preservation until the suit is resolved," she continued.


Justice Singh also ordered that the equity shares in three Indian companies owned by the deceased cannot be altered, and prohibited the sale of his personal belongings, including artwork.


The court emphasized that if the assets are not safeguarded and Priya Kapur fails to validate the will, the children from his marriage with Karisma Kapoor and his mother, Rani Kapur, could lose their rightful inheritance.


"I have prohibited any alienation, transfer, or liquidation of the equity shares in the three companies. Additionally, I have restricted the withdrawal of the PF amount and funds from the three accounts, except for liabilities owed to the children," the judge added.


The court clarified that this order does not pertain to any immovable foreign assets.


A detailed copy of the court's decision is still pending.


Sunjay Kapur passed away on June 12, 2025, after collapsing during a polo match in England, reportedly due to a sudden cardiac arrest.
