CBDT Introduces Comprehensive Crypto Reporting Guidelines
The Central Board of Direct Taxes (CBDT) has unveiled a comprehensive guidance note detailing the implementation of crypto-asset reporting as per the Income Tax Act, 2025. This initiative aims to align India's reporting practices with the Organisation for Economic Co-operation and Development's (OECD) Crypto-Asset Reporting Framework (CARF), thereby establishing a more organized approach to reporting cryptocurrency transactions.
This guidance specifically addresses Reporting Financial Institutions (RFIs), including providers of crypto-asset services, and outlines the compliance requirements they must adhere to when reporting crypto transactions to tax authorities. Notably, this guidance does not change the existing tax obligations for crypto investors. The current tax structure, which includes a 30% tax on profits from Virtual Digital Assets (VDAs) and a 1% Tax Deducted at Source (TDS) on qualifying transactions, remains intact. The focus of the new framework is to enhance the reporting processes utilized by crypto exchanges, allowing the Income Tax Department to verify disclosures more effectively.
Uniform Crypto Reporting Framework Introduced by CBDT
Rajagopal Menon, Vice President of WazirX, stated, "Exchanges play a crucial role in upholding strong reporting standards, ensuring transparent record-keeping, and assisting users in fulfilling their tax responsibilities confidently. While the tax reporting framework has not changed from the previous year, the importance of accurate reporting has increased significantly. Investors who trade across various exchanges often struggle with reconciling numerous transactions manually, which raises the risk of errors." He further emphasized, "We believe that accurate reporting should not be solely the responsibility of users. Therefore, we are enhancing our automated tax reporting capabilities with Taxlyst, ensuring that every trade, transfer, and taxable event is accurately tracked and reported. This also allows exchanges to provide higher-quality data to reporting entities, facilitating informed decision-making."
Essential Steps for Crypto Investors Before Filing Returns
While taxpayers are not mandated to follow a new filing procedure, experts recommend that maintaining precise documentation is crucial under the updated reporting system. Here are some suggested actions:
- Obtain annual transaction statements from all crypto exchanges utilized, including those that are inactive.
- Ensure TDS certificates align with the crypto income reported in their Income Tax Returns (ITR), particularly if trading occurred on multiple exchanges.
- Thoroughly check transaction records prior to filing returns, as discrepancies are likely to be detected more swiftly under the standardized reporting framework.
Following these steps can help minimize the risk of discrepancies when the information reported by exchanges is compared against tax filings.
