New Delhi: The Mumbai Police have filed charges against actor Ajaz Khan following a complaint from Bajrang Dal regarding inappropriate content in his OTT series 'House Arrest', as confirmed by an official on Saturday.
If found guilty, Khan could face a prison sentence of up to three years.
In addition to the charges related to indecent representation of women, Khan and the production team are also facing accusations under Section 67 of the Information Technology (IT) Act, 2000, which addresses the distribution of obscene material in electronic formats.
The FIR lodged at Amboli Police Station includes allegations against Khan and others for disseminating content deemed lascivious or corruptive.
For a first-time offense, the penalty can be up to three years in prison and a fine of up to ₹5 lakh, while repeat offenders may face up to five years in prison and fines reaching ₹10 lakh.
Khan is also charged under Section 296 of the Bharatiya Nyaya Sanhita (BNS), which pertains to obscene acts and songs, carrying a potential three-month sentence.
This legal provision forbids performing or uttering obscene acts or words in public spaces with the intent to disturb others, according to officials.
The FIR also cites Section 4 of the Indecent Representation of Women (Prohibition) Act, 1986, which prohibits the production and distribution of materials that indecently represent women, with a maximum penalty of three years.
The Mumbai Police are also holding the OTT platform's executives accountable, as the FIR invokes Section 7 of the Indecent Representation of Women Act.
This section states that if a company commits an offense, all individuals responsible for the company's operations at the time of the offense can also be held liable.
On Friday, the National Commission for Women (NCW) summoned Ullu OTT platform's CEO Vibhu Agarwal and Ajaz Khan for questioning regarding the alleged obscene content.
Following significant backlash from women's groups, the OTT platform has removed the controversial show.
Chitra Wagh, President of the Maharashtra BJP Mahila Morcha, has called for a ban on the series, labeling it as 'the epitome of vulgarity.'
