Trial Preparations Intensify in Zubeen Garg Death Case

The investigation into the death of cultural icon Zubeen Garg is progressing towards trial, with all seven accused appearing virtually in court. The Criminal Investigation Department has cited law and order concerns for their virtual appearance. The court is set to review the case on December 22, where it may be committed to the sessions court for trial. This case has drawn significant public attention following Garg's mysterious death in Singapore, prompting demands for a thorough investigation. Legal representation has been arranged for the accused amid ongoing developments.
 

Legal Proceedings Advance in Zubeen Garg Case


Guwahati, Dec 16: The legal proceedings regarding the death of renowned cultural figure Zubeen Garg progressed towards trial on Tuesday, as all seven defendants appeared before the Kamrup Metropolitan Chief Judicial Magistrate (CJM) court via video link.


The defendants were connected virtually from Baksa and Haflong jails, as the Criminal Investigation Department (CID) cited concerns over law and order for not bringing them in person.


Previously, the CJM had ordered their appearance in relation to Case No. 4084/2025, which was initiated following a comprehensive chargesheet submitted by the CID’s Special Investigation Team (SIT).


During the online session, the chargesheet was officially delivered to each accused in their respective facilities, and the court ensured that their families were informed about its details.


Pen drives containing extensive information regarding the charges against each individual were distributed to aid in their legal consultations, as explained by advocate Pradeep Konwar.


He noted that the court also monitored procedural adherence and the welfare of the accused.


“The chargesheet copies have been provided in the jails, family members have been thoroughly briefed, and the accused were asked about their health and receipt of documents during the virtual session,” Konwar stated.


He mentioned that while the next hearing on December 22 might also be conducted online, the format would change once formal charges are established.


“Once charges for murder and other offenses are framed, the accused will need to appear in person, as their physical signatures will be required at that point,” he added.


The CJM has scheduled the next hearing for December 22, when the court is anticipated to consider transferring the case to the sessions court for trial.


If the case is moved, trial proceedings are expected to begin shortly thereafter, according to Konwar.


The court also acknowledged the presence of a defense attorney representing the accused.


Advocate Dhrubajyoti Das was appointed by the District Legal Services Authority to ensure legal representation, as required by law.


This appointment follows a prior decision by the Bar Association stating that its members would not defend in this case.


In this context, Anita Deka Mahanta, the spouse of the main accused Shyamkanu Mahanta, has reportedly been seeking legal representation and previously approached the Bar Association, asking them to reconsider their stance.


The SIT has identified seven individuals in its chargesheet, with four facing murder charges under applicable legal provisions.


Zubeen Garg passed away under unclear circumstances on September 19 while swimming in Singapore, where he had gone to perform at the Northeast India Festival.


His untimely death sparked significant public outcry and calls for a thorough investigation, resulting in the formation of the SIT.
