Legal Challenges for Tamil Nadu's New Government

The newly elected government of C. Joseph Vijay in Tamil Nadu is facing significant challenges. Following recent tender and administrative disputes, the matter has escalated to the highest court in the country. A Public Interest Litigation (PIL) has been filed in the Supreme Court, demanding an investigation by the Central Bureau of Investigation (CBI) into the trust vote won by Vijay's 'Tamilga Vetri Kazhagam' (TVK) government, along with a call for President's Rule in the state.

This demand arises from allegations of extensive 'horse-trading' during the trust vote held on May 13.

In this trust vote, the government led by C. Joseph Vijay and his party, TVK, emerged victorious. The petition also seeks a CBI investigation into the alleged corruption linked to the 'floor test' conducted in the Tamil Nadu Assembly, with a request for court oversight on the investigation.

Allegations of Unethical Political Tactics

The petition was filed by K.K. Ramesh, a resident of Madurai, who accused Vijay's government of employing unethical political strategies that allegedly undermined democratic principles. According to the petition, TVK failed to secure a clear majority in the assembly elections but later garnered support through financial incentives and political pressure to win the trust vote.

The petition states, "In the Tamil Nadu Assembly, some legislators from other parties were reportedly involved in horse-trading, and TVK allegedly offered substantial sums to certain legislators. Some legislators are said to have violated their party's 'whip' in exchange for money and other benefits."

TVK's Rise and Support from Other Parties

In the assembly elections, TVK emerged as the largest party with 108 seats. Subsequently, the party received unconditional support from leftist parties, including CPI and CPI(M), as well as VCK and several independent legislators. This backing enabled the party to surpass the majority threshold and form the government, leading to Vijay taking the oath as Chief Minister.

Call for Immediate Action

The petitioner has urged the Supreme Court to recommend the imposition of President's Rule in the state until the investigation is concluded. The petition argues that the alleged irregularities during the floor test have caused serious damage to constitutional ethics and democratic institutions.
