Supreme Court's Decision on Pawan Khera's Bail
Congress MP Pawan Khera faced a setback as the Supreme Court declined to extend his transit bail, which was sought in a case filed by Riniki Bhuyan Sarma, the wife of Assam's Chief Minister Himanta Biswa Sarma. This development occurred just two days after the Supreme Court suspended his anticipatory bail granted by the Telangana High Court. The ruling was delivered by a bench comprising Justices JK Maheshwari and Atul S. Chandurkar. The court clarified that its order from April 15 would not adversely affect the jurisdiction of the court in Assam that is set to hear the case regarding the Congress leader's plea.
The court emphasized that neither the Supreme Court nor the Telangana High Court would interfere with the proceedings of the Assam court handling this matter. According to reports from a news agency, the bench stated that the court responsible for deciding on the plea would not be improperly influenced by the transit bail or any other orders. This indicates that when the competent court receives the anticipatory bail application, it will make its decision independently, without being swayed by prior orders. Furthermore, the court mentioned that the respondent has the complete freedom to approach the appropriate court. If the court is not functioning, a request can be made to the court registry, which will act in accordance with the law. In light of these considerations, the application is now deemed concluded.
