Supreme Court's Decision on Election Commissioner Appointment Process

The Supreme Court has reserved its decision regarding whether petitions challenging the law governing the appointment process of the Chief Election Commissioner (CEC) and other election commissioners should be referred to a larger bench of five judges. A bench comprising Justices Dipankar Dutta and Satish Chandra Sharma requested the petitioners and the central government to submit written arguments on this matter. The bench stated, 'We are reserving our decision on the question of reference to a larger bench.'

The court is currently hearing several petitions that contest the constitutional validity of the Chief Election Commissioner and Other Election Commissioners (Appointment, Conditions of Service and Tenure) Act, 2023. This law excludes the Chief Justice of India (CJI) from the selection committee responsible for appointing election commissioners. Under the provisions of this 2023 law, the selection committee includes the Prime Minister, a minister nominated by the Prime Minister, and the leader of the opposition in the Lok Sabha or the leader of the largest opposition party.

Public interest litigations argue that excluding the CJI from the selection committee undermines the independence of the appointment process for election commissioners. Various petitioners, including Congress leader Jaya Thakur and the Association for Democratic Reforms, have challenged this law.
