CJI Emphasizes Need for Fair Investigations

On Tuesday, Chief Justice of India, Justice Surya Kant, asserted that anyone who crosses borders to commit atrocities against innocent individuals will face appropriate legal action. He emphasized the necessity of a completely independent, fair, and transparent investigation, stating that without accountability, such inquiries would be meaningless. The Supreme Court has indicated its intention to establish a high-powered committee to investigate incidents of violence that occurred in Delhi and other states.

During the hearing, the Chief Justice insisted that a thorough investigation is essential, leaving no room for doubt. He reiterated that the inquiry must be impartial and transparent, with details about its structure to be announced later. This statement was made while the Supreme Court was hearing petitions related to police actions against protesters during the 'Parliament March' on July 20. The bench, comprising CJI Surya Kant, Justice Joymalya Bagchi, and Justice V Mohana, is addressing demands for action against culpable police officers and the establishment of nationwide guidelines for future protests. Senior Advocate Gopal Shankaranarayanan highlighted that the case is linked to protests occurring across the country, with incidents reported in Madhya Pradesh, Nagpur, and Bihar, indicating that the issue extends beyond Delhi.

CJI Acknowledges Various Allegations in Petitions

CJI Surya Kant noted that the petitions contain multiple allegations. He pointed out that one significant issue involves the use of pellet guns, which resulted in a 19-year-old losing his eyesight. There have also been reports of electric baton usage, leading to a young woman being admitted to the ICU. Allegations of severe injuries caused by batons with nails have surfaced, along with a case involving an attack on a journalist, who was reportedly beaten mercilessly. Furthermore, claims have been made regarding police officers in plain clothes engaging in violence, including an incident where a female protester was slapped without provocation. He mentioned that a separate petition has been filed today concerning excessive police action.

CJI Highlights the Nature of Student Protests

The Chief Justice remarked that the protests by students were entirely peaceful, raising specific demands. He noted that extensive arguments are unnecessary, as the protests were conducted within constitutional bounds. He expressed concern that uninvited individuals often infiltrate peaceful demonstrations, bringing their agendas and quickly becoming co-organizers of the events. Students have reported mistreatment despite exercising their constitutional rights. CJI Surya Kant urged all parties involved to come forward with constructive suggestions. He emphasized the need to determine appropriate measures, such as the use of tear gas, and whether their deployment should be permitted, asserting that protests are an integral part of democracy.
