Punjab High Court Orders Government to Justify Rejection of Amritpal Singh's Parole Request
Court Hearing on Amritpal Singh's Parole Application
During a recent hearing regarding the parole application of Amritpal Singh, a Member of Parliament from Khadur Sahib currently incarcerated in Dibrugarh Jail, the Punjab and Haryana High Court instructed the Punjab government to present the fundamental grounds and evidence that led to the rejection of the parole request. The Chief Justice, along with Justice Sanjeev Beri, has scheduled the next hearing for December 8, following a request from the Punjab government for additional time.
In court, Senior Advocate Anupam Gupta, representing the Punjab government, argued that the case is linked to national security and public interest. He expressed concerns that granting parole to Amritpal could allow him to speak freely, potentially disrupting law and order. The Punjab government further contended that permitting his speech could ignite tensions in the region, particularly concerning the five rivers of Punjab.
Arguments Presented by Amritpal Singh's Counsel
Rajvinder Singh Bains, a senior advocate representing Amritpal, countered that the state government had misused its discretion under Section 15 of the National Security Act (NSA) by issuing a 'secret' rejection order without specific facts. He argued that Amritpal does not intend to enter Punjab but wishes to fulfill his parliamentary duties while in custody. Bains suggested that parole could be granted under strict conditions, and Amritpal is willing to comply with any imposed restrictions.
Bains questioned how allowing Amritpal to attend Parliament could pose a threat to national security, emphasizing that the state's claims must be legally justified and fair. He highlighted that Amritpal aims to address the damage caused by the floods in Punjab last August, which affected around 800 villages in his constituency.
