Congress Takes Action Against MLA
The Congress party in Kerala has expelled Palakkad MLA Rahul Mamkootathil following serious allegations of rape and sexual misconduct made by two women. This decision was confirmed by the party's state president, Sunny Joseph.
This action comes after a Kerala court denied Mamkootathil anticipatory bail in connection with the ongoing rape case.
On November 28, the MLA was charged after a woman accused him of rape, claiming he used deceit to gain her consent and coerced her into terminating her pregnancy.
Additional accusations include verbal threats and violations of the Information Technology Act.
Another woman has also accused Mamkootathil of sexual abuse occurring in 2023, which she reported to the Congress leadership via email.
This led to a second FIR being filed against him.
In his defense, Mamkootathil sought anticipatory bail, asserting that the allegations were false and politically motivated, aimed at damaging his reputation. He acknowledged having a physical relationship with the complainant but insisted it was consensual.
Sunny Joseph remarked that the Congress leadership had been consulted about Mamkootathil's expulsion, stating, "It is better that he quits as a legislator." He emphasized that the party has never shielded him.
Joseph further noted that Mamkootathil's continued membership had become "ethically untenable."
Previously, the Congress had suspended Mamkootathil from its primary membership in August due to multiple allegations of misconduct from various women. Following this, he resigned from his position as the Kerala Youth Congress chief.
The first FIR also invoked provisions from the Drugs and Cosmetics Act and the Medical Termination of Pregnancy Act.
Investigations are underway regarding claims that Mamkootathil obtained abortion-inducing medications without a prescription and pressured the woman to take them while he monitored her via video call. An acquaintance, Joby Thomas, has been identified as the second accused in this case.
The Medical Termination of Pregnancy Act stipulates that only licensed medical professionals can administer abortion pills after conducting necessary tests, including an ultrasound.
