Judge Steps Aside from Codeine Syrup Case

In a significant development regarding the codeine syrup case, Justice Krishna Pehal of the Allahabad High Court has recused himself from the proceedings after attempts were made by the petitioner to contact him directly. The court was in the process of hearing multiple bail applications, including one filed by Bhola Prasad. The judge emphasized, “It is not only essential for justice to be served, but it must also be evident and beyond doubt.”

The court remarked, “Any attempt by a party or lawyer to create an extrajudicial means of communication with a judge regarding a pending case is entirely against the ethical standards of the legal profession and the constitutional values of an independent judiciary.”

In its order on Thursday, the court expressed, “This court records with deep sorrow and a sense of institutional responsibility that this incident marks a dark day in the history of this court.”

The integrity of the judicial institution relies on the unwavering public trust that justice is administered fairly, fearlessly, and without external influence.” The judge stated, “Any attempt to interfere with or influence the judicial decision-making process, no matter how minor or covert, is a direct assault on the rule of law.”

During the hearing, the court decided to conduct final hearings in all cases on Thursday, with a ruling to be delivered at a later date. However, attempts were made by the petitioners to reach out to the judge. The court concluded, “To maintain the dignity of this institution, safeguard the integrity of the judicial process, and eliminate any doubts regarding fairness in justice, this bench finds it appropriate to recuse itself from hearing these matters.”

The judge indicated that these cases would be forwarded to the Chief Justice of this court for reassignment to an appropriate bench.
