Indian Employee Secures £67,000 After Winning Race Discrimination Case Against KFC in London
Compensation Awarded for Racial Abuse
London: An Indian national has been awarded nearly £67,000 in compensation after a tribunal found in his favor regarding claims of wrongful termination and racial discrimination at a KFC outlet in southeast London.
Madhesh Ravichandran, originally from Tamil Nadu, testified during the tribunal that his manager, a Sri Lankan Tamil, subjected him to discriminatory remarks, including derogatory terms like 'slave' and accusations that 'Indians are fraudsters.'
The tribunal's judge, Paul Abbott, confirmed the validity of Ravichandran's claims of wrongful dismissal and racial bias against Nexus Foods Limited.
The judgment stated, 'The complaints of direct race discrimination are well-founded and succeed.'
It further elaborated that Ravichandran experienced unfavorable treatment, including the denial of his holiday requests based on his Indian nationality, as his manager preferred requests from Sri Lankan Tamil staff.
Ravichandran began his employment at the West Wickham KFC in January 2023, reporting directly to Kajan, his manager.
After enduring several issues, tensions escalated in July when Kajan attempted to impose excessive working hours on him, prompting Ravichandran to resign.
Judge Abbott acknowledged that Ravichandran's resignation was influenced by Kajan's ongoing attempts to force him into long shifts, during which Kajan allegedly became 'racially abusive and threatening.'
The judgment noted, 'This racial abuse from a manager had the purpose and effect of violating the claimant's dignity.'
The tribunal determined that Ravichandran was 'summarily dismissed' while still serving his notice period, denying him the legal right to a week's notice.
'The respondent did not claim that the claimant had done anything to justify his dismissal without notice. Therefore, the claimant was wrongfully dismissed and is entitled to one week's pay in lieu of notice,' the ruling stated.
Following the tribunal's findings in September, Ravichandran was awarded £62,690 in compensation, along with additional payments for holiday pay and employment-related details, bringing the total to approximately £66,800.
Moreover, the tribunal mandated Nexus Foods Limited to establish a 'training program for all employees on workplace discrimination, including training for managers on proper grievance handling' within six months of the ruling.
