Court's Stance on Corruption and Retired Officials
The Allahabad High Court has asserted that retired individuals should not be exempt from scrutiny regarding the rising corruption within government departments due to certain vested interests.
Justice Manju Rani Chauhan made this observation while dismissing a petition filed by a retired technical assistant engineer.
The retired engineer challenged an investigation initiated against him based on a complaint from a relative of a legislator. Vipin Chandra Verma argued that the authorities had no right to issue a show-cause notice in September 2025 concerning alleged irregularities from 2015 to 2022. Verma had retired on June 30, 2025.
A complaint regarding these irregularities was submitted to the Assembly Speaker in April 2025, prompting the district magistrate to investigate the matter. The petitioner's lawyer contended that the complaint was politically motivated and that relevant regulations were overlooked during the consideration of the complaint.
The lawyer further argued that since the petitioner retired in June, there was no longer an employer-employee relationship between him and the respondent officials, and thus, no notice should have been issued under these circumstances.
The advocate also pointed out that Rule 351-A of the Public Service Regulations prohibits departmental action against a retired officer in cases older than four years. However, the government advocate noted that the investigation report dated August 23, 2025, identified irregularities from 2022, which falls within the four-year limit.
The court emphasized that a public servant's role extends beyond merely receiving a salary; they are expected to contribute to nation-building, thus carrying a significant responsibility.
Furthermore, the court stated that the public or their representatives should have the option to expose any negligence by a government employee in their official duties, regardless of whether the employee is active or retired. The court instructed the petitioner to cooperate fully with the investigation and adhere to the applicable regulations governing retired government employees.
