High Court Revokes Bail of Twisha Sharma's Mother-in-Law in Murder Case
Court Decision on Bail Revocation
In the tragic case of Twisha Sharma's murder, Ankur Pandey, the attorney representing the victim's family, announced that the Jabalpur High Court has annulled the anticipatory bail granted to Giribala Singh, the mother-in-law of the deceased. This decision came after the court reviewed arguments from all parties involved and objections related to the investigation.
The case involves serious allegations under the newly established Indian Justice Code, 2023, and the Dowry Prohibition Act, 1961. Pandey mentioned that the High Court listened to the arguments from Giribala Singh, the state, and Twisha Sharma's father before making its ruling.
Arguments Presented in Court
The High Court found that the lower court had prematurely concluded that there was insufficient evidence before the investigation was completed. Pandey further alleged that after receiving bail, Giribala Singh attempted to tarnish Twisha Sharma's reputation and failed to cooperate with investigators. He stated, 'It was also argued that after being granted bail, Giribala Singh tried to damage Twisha Sharma's image and did not assist the investigators. Considering these points, the High Court revoked her anticipatory bail.'
He recounted that an FIR was filed against Giribala Singh and Twisha's husband, Samarth Singh, who evaded arrest for several days before surrendering in Jabalpur.
Concerns Over Investigation Delays
Pandey criticized the delay in filing the FIR, noting that it took three days, and anticipatory bail was granted in less than 24 hours after the investigation began, which is unusually swift for such a serious case. The victim's family repeatedly raised concerns with authorities, sending letters and complaints. Hurt by the bail order, Twisha's father challenged it in the High Court, which later joined the state in arguing that granting bail was inappropriate.
High Court's Final Ruling
On Wednesday, the Madhya Pradesh High Court revoked the anticipatory bail previously granted to Giribala Singh by the 10th Additional Sessions Judge in Bhopal on May 15. Singh faces charges under Section 80(2) for dowry murder, Section 85 for cruelty by a husband or relatives, and Section 3(5) for acts committed with a common intention. Additionally, cases have been filed against her under Sections 3 and 4 of the Dowry Prohibition Act. This development follows the death of Twisha Sharma, a resident of Noida, who reportedly died due to mental torture and dowry harassment inflicted by her husband and his family.
