Court Ruling on Waqf Institutions

On Wednesday, the Gujarat High Court made a significant ruling by rejecting nearly 150 petitions from Muslim waqf institutions that sought exemption from court fees.


Justice J.C. Doshi dismissed these petitions, which included various disputes related to rental claims, possession issues, and rights over significant properties across the state.


Waqf trusts such as the Sunni Muslim Idgah Mosque Trust, Vadodara City Mosque Assembly Trust, and the Sarkhej Roza Committee from Ahmedabad had challenged orders from the Gujarat State Waqf Tribunal that mandated payment of court fees before hearing their disputes.


The court determined that the petitioners had requested reliefs from the tribunal that were inherently contradictory, necessitating a judicial determination of the rights and obligations of the parties involved.
