Gujarat Government Enforces New Consumer Rights Regulations
Gujarat's New Consumer Protection Initiative
The Gujarat government has recently implemented a significant measure aimed at safeguarding the rights and interests of consumers. From now on, if a retailer refuses to accept the return of purchased goods, they will face penalties and potential legal action.
Typically, stores display signs stating 'No returns on sold items,' implying that once a customer has purchased an item, it cannot be returned. However, this practice can lead to serious repercussions for shopkeepers, as it infringes upon consumer rights.
In response, the Gujarat government has issued a new circular that allows customers to return purchased items, mandating that retailers must accept these returns.
Legal Rights Regarding Returns
1. Retailers Cannot Refuse Returns
The Gujarat government has mandated that if a customer returns an item in its original condition, the retailer cannot refuse to accept it. Should a retailer deny the return, the customer has the right to file a complaint with the consumer court. This could lead to legal action against the retailer, including fines.
2. Rights Under the Consumer Protection Act, 2019
The Consumer Protection Act of 2019 was established to protect consumer rights. If a purchased item is found to be defective, customers are entitled to a replacement or a full refund. Additionally, if a customer suffers any harm or loss due to a purchased item, they can seek compensation.
3. Where to File Complaints
If a retailer refuses to accept a return, customers can lodge complaints with the district, state, or consumer commission. They can also call the national consumer helpline at 1800-11-4000 or file complaints online through consumer-related websites.
