Delhi High Court Urges Government to Strengthen School Tribunal Regulations

The Delhi High Court has ordered the Delhi government to strengthen the Delhi School Tribunal by creating regulations within three months. This directive comes after a lack of action since a 2010 suggestion by the court. The judges emphasized the need for legal provisions to enforce tribunal orders, questioning the difficulties in empowering the tribunal. A petition from the NGO Justice for All highlighted that current laws prevent private school employees from enforcing tribunal decisions. The court hopes for prompt action from officials to address these issues.
 

Court Directs Action on School Tribunal Regulations

The Delhi High Court instructed the Delhi government on Wednesday to enhance the Delhi School Tribunal and establish regulations within three months to ensure effective implementation of its orders.


A bench comprising Chief Justice D.K. Upadhyay and Justice Tejas Karia noted that a suggestion to formulate these regulations was made by the full bench of the High Court back in 2010, yet the relevant authorities have failed to take action.


The court highlighted the absence of any legal provisions for enforcing the orders of the Delhi School Tribunal, stating that this situation cannot persist. The judges questioned, 'What is the difficulty in empowering the tribunal?'


Furthermore, the court expressed hope that the concerned officials would consider the necessity of an implementation mechanism and take appropriate measures. They emphasized the need for prompt decisions and actions to be taken within three months as a priority.


A non-governmental organization (NGO) named Justice for All filed a petition regarding this matter. The petitioner pointed out that under the current legal framework, no private school employee who is a victim can initiate action to enforce the tribunal's orders.
