Injunction Against Unauthorized Content
Justice Jyoti Singh, presiding over the case, has prohibited several defendants from creating, distributing, or publishing any content that employs Gambhir's identity without proper authorization. This includes the use of deepfakes, altered images, AI-generated videos, and false statements.
Concerns Raised by Gambhir's Legal Team
Representing Gambhir, lawyers Jai Anant Dehadrai and Srutee Priyadarshini highlighted that numerous social media accounts and online vendors were exploiting his persona to disseminate false information and market unauthorized products. The court acknowledged these concerns, noting that such actions infringe on personality rights and can inflict significant reputational damage. Consequently, an interim injunction was issued to prevent further misuse.
Instructions for Online Platforms
The court has also instructed e-commerce giants Amazon and Flipkart to eliminate listings that misuse Gambhir's identity. Social media and technology platforms, including Meta (Instagram) and Google (YouTube), are required to remove specified links within 36 hours of receiving the court's order.
Accountability for Infringing Content
Additionally, these platforms must provide information regarding those responsible for the infringing content. This includes seller details from e-commerce sites and subscriber information along with IP logs from social media platforms.
